The Homeland is Secure from Unwanted Sexual Advances
Here's a story that has attracted a great deal of attention the past couple of weeks. It is being treated as a First Amendment issue, and rightly so; however, there is another issue raised by this story that has not been given attention.
It happened in Bethesda, Maryland, a suburb of Washington, DC. Two uniformed Homeland Security officers walked into a public library and loudly announced that it was forbidden to view pornography on library computers. Then they began going around the room, checking to see what patrons were viewing. After determining that three patrons--all adults--were viewing "pornographic" websites, they told the patrons to step outside.
At this point, the library manager intervened and told the officers that their actions were inappropriate. It turns out that there is no library policy that restricts the Internet activity of adults, although in some cases a privacy screen may be required. The officers disagreed, saying that the display of "pornographic" websites on a library computer was a violation of the county's sexual harassment policy.
The incident ended with the police being called and the police asking the Homeland Security officers to leave.
This, however, was not the end of the matter. After the incident came to light in the Washington Post, Montgomery County's chief administrative officer Bruce Romer apologized for the incident and announced that the Homeland Security officers would be reassigned. It was also announced that security personnel would now receive additional training to ensure that they "understand library policy and its consistency with residents' First Amendment rights under the U.S. Constitution."
This is good. Homeland Security officers should be aware of the existence of the First Amendment, and if they are unaware, someone should tell them about it.
However, this additional training, while necessary, does not address the reason why this incident happened in the first place.
Michael J. Knapp, the head of the county's Homeland Security Committee, explained that the incident occurred because officers faced "two or three competing policies" and "probably didn't interpret them as well as we'd like."
In other words, the officers had been charged with enforcing the county's sexual harassment policy, and their only mistake was in misunderstanding library policy and the right of library patrons to surf the Internet without official scrutiny.
And there's the problem. The Department of Homeland Security was ostensibly set up to fight terrorism. So why is it fighting sexual harassment?
As bad as sexual harassment might be for the individuals involved, it cannot by any stretch be considered a threat to the "Homeland"--further proof that the Department of Homeland Security was never set up to fight the phantom threat of terrorism, but rather, to increase federal police power over every aspect of human life ...
