Update: San Marcos River Incident

In the face of a deafening public outcry, Texas State University officials and police in San Marcos, Texas, have dropped all charges against Dave Newman, the man who was arrested after rescuing another man from drowning; they have also acknowledged his heroism. However, Newman has yet to be given any assurance that his arrest will be removed from police records and his name expunged from all criminal databases.

Dave Newman, the man who was arrested after rescuing another man from drowning (see 7/6/05 entry below), speaks out:


A man is alive because I acted,
so why am I in trouble?

Overall, I have a feeling of comfort and satisfaction in just knowing that I was able to save the life of another human being. I was just in the right place at the right time.

On Sunday in San Marcos, I feel that I made a correct decision to momentarily delay complying with police directives in order to make one more dive into the underwater cavity where Abed Duamni had been trapped for more than 10 minutes.

I knew time was of the essence if a rescue was possible at all, but I did believe at the time that Duamni more than likely had already drowned.

I knew that I had touched something in that cavity on the previous attempt, and I made a decision to go down for one more try, against police orders. On that last attempt, I did locate the trapped swimmer. I was able to extract him from the underwater cavity and push him toward the surface. When I surfaced, I was overwhelmed with astonishment to find him alive and well, clinging to a wall amid the turbulent water.

I was also amazed that the police subsequently arrested me and took me to jail. I did take a few moments to catch my breath on the other side of the river before I had to swim again, this time over to the officers, but I maintain that I complied with their request to exit the river, immediately after the higher priority of saving that man's life.

From the police news conference on Tuesday, I was hoping for some good news that the Fire Marshall's office and the Texas State University-San Marcos Police Department might have reconsidered their decision to prosecute, but it appears that police actually have arrived at the conclusion that I was part of the problem.

Officials even raised the question as to whether I had actually rescued that man at all, and they implied that Duamni had somehow rescued himself.

Had there been divers in the area, ready to take over, I would have gladly moved aside, yet I saw no rescue divers at the scene. Having been underwater for 10 minutes already, Duamni may or may not have survived long enough under there for a rescue response team to get him out alive. I knew and hoped that maybe I had a chance there to help him, and I stand by the decision that I made that day.

I can only hope that if under slightly different circumstances - that if I were in dire need or trouble - some good Samaritan would come to my aid. I have been helped by others in the past, and I feel that it is my obligation and duty to do the same.

I still have a criminal charge hanging over my head, a brand new police record and legitimate concerns about how this will affect my professional career.

I hope that the fire marshall's office and the police will come to their senses and let this matter drop.

Netanyahu Changed Plans Due to Warning

JERUSALEM - British police told the Israeli Embassy in London minutes before Thursday's explosions that they had received warnings of possible terror attacks in the city, a senior Israeli official said.

Israeli Finance Minister Benjamin Netanyahu had planned to attend an economic conference in a hotel over the subway stop where one of the blasts occurred, and the warning prompted him to stay in his hotel room instead, government officials said.

Foreign Minister Silvan Shalom said he wasn't aware of any Israeli casualties.

Just before the blasts, Scotland Yard called the security officer at the Israeli Embassy to say they had received warnings of possible attacks, the official said. He did not say whether British police made any link to the economic conference.

The official spoke on condition of anonymity because of the nature of his position.

The Israeli Embassy was in a state of emergency after the explosions in London, with no one allowed to enter or leave, said the Israeli ambassador to London, Zvi Hefet.

All phone lines to the embassy were down, said Danny Biran, an Israeli Foreign Ministry official.

The ministry set up a situation room to deal with hundreds of phone calls from concerned relatives. Thousands of Israelis are living in London or visiting the city at this time, Biran said.

Amir Gilad, a Netanyahu aide, told Israel Radio that Netanyahu's entourage was receiving updates all morning from British security officials, and "we have also asked to change our plans."

Netanyahu had been scheduled to stay in London until Sunday, but that could change, Gilad said.

Texas Man Arrested after Heroic Rescue

A man rescues another man from drowning in the San Marcos River. EMS and cops arrive. While the man is depositing the rescued man on the bank, he can hear the the cops on the opposite bank barking orders for him to come out of the water. But he does not obey fast enough; having just exerted himself past the point of endurance, the 48-year-old man is too exhausted to immediately jump out of the water; also, he must wait an additional 15 seconds for turbulence from the waterfall that caused the incident to clear. So, as soon as it is safe, he swims towards the cop. And, when he reaches the bank and extends his hand, expecting assistance from the cop, he's handcuffed!

To be fair, the cops thought there might be additional persons in need of rescue, thus wanted to clear the area; but why on earth did they feel it necessary to handcuff the man who had performed the rescue? Couldn't the rule about obeying-every-order-within-a-split-second have been suspended this one time?!?

Not only that, in full knowledge of the rescue and all circumstances, the cops took the man to jail, kept him there all night, then released him the next day on $2,000 bail!

And that's not the end of it. After the story made national headlines, did the cops issue a public apology and drop the charges? No, in a press conference, they continued to defend the arrest on grounds that the man was "uncooperative," and, when asked if charges might be dropped, could only give the half-assed reply: "Anything is possible."

This story is typical; but it is not the worst of such stories. The man is lucky he wasn't Tasered till he had a heart attack and died.
